The Disciplinary Committee of the Royal College of Veterinary Surgeons has directed that the name of a veterinary surgeon who had been practising in Essex be removed from the RCVS Register, having found him guilty of attempting to obtain medicines dishonestly.
James Alexander Lockyear, a graduate from Pretoria University in South Africa, was charged with two offences. The case was heard in his absence, although the Committee did not draw any adverse inference from this. One charge concerned his attempted purchase of steroids from a pharmacy in Colchester by dishonestly representing that the medicine was for legitimate veterinary use. The second charge related to several instances of what the Committee referred to as "inappropriate and unprofessional behaviour", including showing an offensive image to another staff member on a mobile phone, placing the testicle of a castrated dog in his mouth and the misuse of an endotracheal tube.
All of the incidents had taken place between April 2008 and September 2009, while Mr Lockyear was practising as a locum veterinary surgeon at St Runwald's Veterinary Surgery, Colchester, Essex.
The Disciplinary Committee heard evidence from a pharmacist, Mr Noble, to whom Mr Lockyear had presented an incomplete veterinary prescription for 12 ampoules of Sustanon, a prescription-only anabolic steroid for humans, and a further pharmacist, Mr Foskett MRPharmS, who outlined his suspicions that the steroids were in fact for Mr Lockyear's personal use (Sustanon is a substance which can potentially be misused in relation to body-building). Mr Lockyear had originally claimed the drugs were for general stock at the practice; he later returned with a second prescription, for double the amount of Sustanon, claiming it was for his own dog; later again, he said the prescription was for a friend's dog.
The Committee also heard evidence from the veterinary owner of the practice, a veterinary nurse and a student veterinary nurse working in the practice team, and from Dr Maddison MRCVS, an expert on small animal clinical pharmacology. Dr Maddison informed the Committee that there was a veterinary alternative to Sustanon, so it was not necessary for that drug to have been sought by Mr Lockyear. She was also of the view that Sustanon would not have been suitable to treat the ailments for which Mr Lockyear claimed it was to be used.
The Committee found Mr Lockyear guilty of the first charge - that is attempting to obtain medicines dishonestly. Chairing the Disciplinary Committee, Mrs Alison Bruce, said: "Whilst it was a one-off incident, it is conduct which falls far short of that which is expected of a member of the profession. It involves serious dishonesty; it represents an abuse of a veterinary surgeon's authority to prescribe drugs; it is conduct which tends to undermine public trust in the profession, and the honesty of its members; it is conduct which compromised other professionals, the pharmacists involved, and undermined the trust which ought to exist between pharmacists and veterinary surgeons generally, in the important area of drug prescription." The Committee therefore directed that Mr Lockyear's name be removed from the Register.
Regarding the second charge, the Committee was most concerned about the incident relating to the dog's testicles, which it felt offended against Mr Lockyear's duty to treat with respect all animals which were his patients. Taking the three incidents as a whole, the Committee felt that Mr Lockyear should be seriously criticised for behaviour that was "unprofessional... juvenile, inappropriate, disgusting and offensive". However, they felt that the conduct was not malicious, and did not occur in the presence of a member of the public, so concluded that this did not amount to disgraceful conduct in a professional respect.
The Council of the Royal College of Veterinary Surgeons has unanimously approved the introduction of a disciplinary system for registered veterinary nurses from 1 April 2011.
The RCVS established the non-statutory Register for Veterinary Nurses in 2007, and says that registration signals a commitment from veterinary nurses to account for their professional practice.
Registered Veterinary Nurses (RVNs) commit to keep their skills up to date via mandatory continuing professional development and abide by the Guide to Professional Conduct for Veterinary Nurses. The disciplinary mechanism is the final component of this regulatory framework. From 1 April 2011, an RVN can be removed or suspended from the Register if found guilty of serious professional misconduct, fraudulent registration or criminal offences affecting his or her fitness to practise.
The decision has been awaited for some time, as according to the College, there has been some dispute about whether an RVN could be removed from the statutory List of Veterinary Nurses (meaning veterinary surgeons would be barred from delegating to them tasks allowed under Schedule 3 to the Veterinary Surgeons Act, such as medical treatment or minor surgery), as well as the non-statutory Register.
Following legal advice that it would not be appropriate to remove someone from a statutory list via a non-statutory regulatory system, RCVS Council and the Veterinary Nurses Council opted for removal from the Register only, with the caveat that any such removed VNs will be clearly identified on the List. In addition, veterinary surgeons will be advised, via the Guide to Professional Conduct, against delegating Schedule 3 tasks to them.
Council also confirmed that it would seek an amendment to Schedule 3 as soon as possible, to enable it to remove the names of nurses found guilty of serious professional misconduct or other charges from the List.
VN Council Chairman Liz Branscombe said: "The Veterinary Nurses Council is committed to moving towards statutory regulation for veterinary nurses. This non-statutory commitment to a disciplinary system is our chance to show government and the public that we are ready and willing to be regulated, which should stand us in good stead for the future."
The RVN disciplinary system will mirror that for veterinary surgeons, with the same complaints-handling, investigation and decision-making processes and sanctions.
Registered Veterinary Nurses will receive more detailed information about the system over the coming months.

The reports summarise the results of two surveys that were conducted between July and August last year.
Of the 28,718 veterinary surgeons who were sent the survey, 22% fully completed and submitted the questionnaire.
Some of the main findings included:
Around 40% of veterinary surgeons and over 40% of veterinary nurses said they had experienced concerns for their personal safety aside from catching Covid.
These safety concerns mostly related to client interactions at the practice either during the day or out-of-hours.
Many respondents experienced conflict between their personal wellbeing and professional role, and found it difficult to juggle their work and caring responsibilities.
Many respondents also said their mental health was adversely affected by the experience of working during the pandemic.
A large majority of respondents said they had personally seen an increase in caseload due to new animal ownership.
Lizzie Lockett, RCVS CEO, said: “While many of the results of the survey may not be especially surprising and confirm what we have already been told anecdotally, it is very important that we have this hard data to hand on the overall impact of the pandemic on individual members of the professions.
“These two reports complement the six surveys that we have conducted with veterinary practices on the economic impact of the pandemic to give us as clear and holistic a picture as possible about the challenges that the professions and the veterinary sector as a whole have faced since March 2020.
"This not only provides a useful historical snapshot, but builds an evidence base to inform future temporary changes should the pandemic continue into more waves, or should future such crises arise.
“The results of the two individual surveys make it clear it has been a tough time for the professions.
"A good proportion of respondents also acknowledged that positive developments have come from the past two years, including the way the profession has demonstrated remarkable resilience, flexibility and adaptability, as well as forging a stronger team spirit under such difficult circumstances.
“However, a large number of both vets and vet nurses who responded said that the experiences since March 2020 have left them feeling more pessimistic about veterinary work and their place within it.
"I would like to reassure members of the veterinary team that the RCVS is aware and understands.
"We tried throughout the pandemic to support the professions with relevant temporary guidance changes, and we are now working with a range of stakeholders on critical issues such as the workforce crisis, which has been in part caused by Covid.
"We are also developing tools, training and resources to support the professions, via our programmes such as RCVS Leadership and Mind Matters.”

Equine Herpes Virus is a contagious virus, which can cause respiratory disease, abortion and more rarely neurological disease. In addition, sub-clinical infections can be associated with a syndrome of poor performance and have a potential effect on the health of the whole yard.1
The disease is transmitted from horse to horse through the respiratory tract, by inhalation of the viral particles shed by infected horses. Once a horse is infected with Equine Herpes Virus it is likely to be latently infected for life. Viral reactivation and nasal shedding can occur at any time, particularly during stressful periods such as when mixing with other horses at equine events. This can lead to acute disease episodes. Often affected horses are asymptomatic but if they do show symptoms these may include depression, lethargy, pyrexia, nasal discharge and a dry cough. Reduction of shedding through management and vaccination is key to disease control.2

MSD has announced that the broad-spectrum clostridial disease vaccine for sheep and cattle, Bravoxin 10, is now available in a new 6 x 100ml farm vaccination pack. The pack contains enough vaccine for 600 sheep or 300 cattle boosters.
Buyers of the new farm pack will also get a free vaccine applicator worth £20. The new Bravoxin 10 applicator benefits from the sterimatic system, which protects and sterilises the vaccination needle with each injection. MSD says it can also be placed down between doses without risk of needle damage, self-injection or needing to remove the vaccine bottle.
Bravoxin 10 protects both cattle and sheep from clostridial diseases like blackleg and black disease, as well as other conditions caused by clostridial bacteria that usually kill the animal once infection has become established. The vaccine protects against disease caused by the 10 main clostridial bacteria; C. perfringens type A, C.perfringens type B, C.perfringens type C, C.perfringens type D, C.novyi type B, C.septicum, C.tetani, C.sordellii, C.haemolyticum and C.chauvoei.
The RCVS Disciplinary Committee has directed that the name of a veterinary surgeon who formerly practised in Norwich should be removed from the Register, having found him unfit to practise veterinary surgery following his Crown Court conviction for fraud.
During the one-day hearing, the Disciplinary Committee heard how Francisco da Cruz had abused his position whilst practising as a veterinary surgeon at Hellesdon Vets, his then workplace in Norwich, by defrauding a insurance companies of around £10,000 with fictitious claims for veterinary treatment on non-existent pets.
Following an investigation by the City of London Police's Insurance Fraud Enforcement Department (IFED), Mr da Cruz was convicted on five counts of fraud by false representation on 21 February 2013 at the Old Bailey in London, and later sentenced to eight months' imprisonment (suspended for two years) and 200 hours of unpaid community work; he was also ordered to pay just over £10,000 in compensation and costs.
Although Mr da Cruz had left the UK for Brazil shortly after his sentencing and was therefore not present at the hearing, the Committee was satisfied that he was deliberately evading the disciplinary proceedings, rather than being genuinely unable to participate in them, and so the hearing proceeded in his absence.
First accepting the copy certificate of conviction against Mr da Cruz as true, the Committee then had no hesitation in concluding that these convictions rendered him unfit to practise as a member of the veterinary profession. It found that the five counts of fraud were deliberate crimes of dishonesty, committed over a significant period of time and for significant financial gain. He had abused his position as a veterinary surgeon and abused the trust which the insurers placed in him as a professional.
Chairing and speaking on behalf of the Committee, Professor Peter Lees, said: "The Committee has no real confidence that there is no significant risk of repeat behaviour from the Respondent. His conduct subsequent to the criminal proceedings gives it no confidence that he has reformed himself to the extent that he will in the foreseeable future be fit to return to practice. So far from satisfactorily completing his criminal sentence, it appears that the Respondent has deliberately gone abroad to avoid doing so."
Bearing in mind that the purpose of any sanction it imposed was not to punish Mr da Cruz, but to maintain public confidence in the profession and uphold proper standards of conduct within it, the Committee concluded that the convictions were too serious to allow any sanction other than removal from the Register.

The Veterinary Record has published what the British Homeopathy Association is calling the first ever systematic review of randomised controlled trials (RCTs) in veterinary homeopathy.
The review was conducted by Dr Robert Mathie, research development adviser to the association, and Dr Jürgen Clausen from the Carstens Foundation, Germany.
They found 18 placebo-controlled RCTs of veterinary homeopathy, published in the peer-reviewed literature, that were eligible for detailed assessment. Of these, only two were judged to provide reliable evidence. The remainder were unclear or had a high risk of bias.
The two studies which were judged reliable were:

(2004) Comparison of homeopathy, placebo and antibiotic treatment of clinical mastitis in dairy cows - methodological issues and results from a randomized-clinical trial. Journal of Veterinary Medicine. A, Physiology, pathology, clinical medicine 51, 439-446. In this study, homeopathy was shown to be ineffective.
Dr Mathie said: "Up to now, debates about the efficacy or effectiveness of veterinary homeopathy have been polarised by the absence of any systematic review of the subject. Our work clarifies the nature of the current RCT evidence."
Mr Mark Elliott, immediate past president of the British Association of Homeopathic Veterinary Surgeons, said: "This important study affirms that reliable evidence does exist and that more research should be done, particularly in light of current concerns about antibiotic resistance in production animals."
It seems a remarkable admission, that the entire veterinary homeopathy edifice rests upon one study in piglets. However, if that study did prove the efficacy of homeopathy, it would of course be an order of magnitude more remarkable than today's admission.

CVS says that in the USA, the veterinary profession is the fifth highest profession for non-fatal injuries, with equine veterinarians sustaining an average of eight serious injuries during their career.
‘The context, consequence and prevention of veterinary workplace injuries: a qualitative and quantitative study in the UK’ will be undertaken at the University of Liverpool in collaboration with CVS colleagues as part of its Clinical Research Awards.
The study will run for three years, supported by £74,400 of CVS funding.
The research will investigate what veterinary injuries are, what context they occur in and what their consequences are.
It will look to highlight areas of the profession where injury prevention training and strategies can be developed and adopted to improve the safety of working in veterinary practice.
For the first phase, University of Liverpool researchers have rolled out the largest ever survey to explore veterinary workplace injuries with over 5,000 CVS staff UK-wide.
The survey investigates how veterinary professionals define injuries, their specific causal mechanisms, and why individuals do or do not report injuries or seek medical treatment.
The survey will be followed by an independent audit of CVS’ accident reporting system.
The results of these two activities will lead to the development of a suite of industry leading ‘open access’ educational tools aimed at promoting injury awareness and prevention to help drive behaviour change and support injury avoidance.\
The research project is being led by Dr. John Tulloch, a Research Fellow and European Specialist in Veterinary Public Health, at the University of Liverpool.
Collaborators include CVS Head of Health and Safety Rebecca Jackson and Director of Learning, Education and Development Dr Martin Whiting.
John said: “Injuries that occur within veterinary practice can tragically at times be life-changing and are often avoidable.
"Currently we do not know some critical details that would help to improve safety within the veterinary workplace.
"If we can better understand these details, we will be able to develop and strengthen prevention measures through policy, education, and training.
"We anticipate that this project will result in safer workplaces within the wider veterinary community and, indirectly, in improved animal treatment through a fitter, healthier and safer profession.”
The intranasal vaccine can be administered to calves from one week old. It reduces the clinical signs of respiratory disease and viral shedding from infection with Bovine Respiratory Syncytial Virus (BRSV) and Parainfluenza-3 Virus (Pi3V).
MSD says that no other UK-licensed BRD vaccine can be administered earlier in life, and claims the vaccine delivers the fastest on-farm protection, with an onset of immunity after administration of 5 days for BRSV and 7 days for Pi3V. Duration of immunity is 12 weeks for both viruses.
MSD Animal Health livestock veterinary adviser Dr Kat Baxter-Smith said: "Having this early life calf pneumonia vaccine available in single dose vials will give farmers more practical leeway to be able to vaccinate vulnerable young calves from as young as a week of age, rather than delaying administration until a batch of calves are available. We know that early-age protection of young calves through intranasal vaccination can help prevent pneumonia and positively impact a beef or dairy calf’s productive future".

Bayer Animal Health has launched Baytril® Max 100mg/ml Solution for Injection for Cattle and Pigs, which replaces the company's previously animal-specific Baytril Max products.
Bayer says the active ingredient, enrofloxacin, treats bacterial infection by inhibiting the action of bacterial DNA gyrase resulting in bacterial cell death.
In cattle, Baytril Max treats respiratory infections and mastitis caused by enrofloxacin-sensitive Histophilus somni, Mannheimia haemolytica, Pasteurella multocida and Mycoplasma spp., and enrofloxacin-sensitive E. coli respectively.
In pigs, Baytril Max targets bacterial bronchopneumonia caused by enrofloxacin-sensitive Actinobacillus pleuropneumoniae, Pasteurella multocida and complicated by Haemophilus parasuis as a secondary pathogen in pigs.
Bayer advises that vets treating cattle for respiratory infections should inject subcutaneously. Mastitis cases should be treated intravenously and pigs should be injected intramuscularly in the neck muscles, behind the ear.

The new Order will come into force on the 18th February 2020, from when students who graduate with the University of Surrey’s veterinary degree will automatically be able to join the Register of Veterinary Surgeons and to practise veterinary medicine in the UK.
The university’s Bachelor of Veterinary Medicine and Science (BVMSci Hons) degree will enter the College’s cyclical accreditation process and be subject to annual monitoring for quality assurance.
Accreditation of the degree was a five-year process during which the RCVS worked with the University of Surrey to ensure that its curriculum and programme met the College’s quality standards, including two interim accreditation visitations in 2017 and 2018 and a final accreditation visit in 2019.
Dr Niall Connell, RCVS President, said: “We are very glad that the University of Surrey’s veterinary degree has now cleared the last hurdle and that, as of next month, it will join the roster as the UK’s eighth recognised veterinary degree. CVS has announced the acquisition of four further veterinary practices bringing the total number of practices it owns across the UK to 92 operating from 253 sites.
The latest practices to join CVS are: Crescent Veterinary Clinic Ltd, Melton Mowbray; Miller & Swann Veterinary Surgery, Elgin; West Mount Vets, Halifax and Anchorage Veterinary Hospital, Acle.
CVS now employs more than 2,300 staff at its veterinary practices and surgeries across the UK and in its related veterinary businesses, including an online pharmacy, two pet crematoriums and six veterinary laboratories.
The Kennel Club is calling on the profession to support Get Fit With Fido, its new campaign to help tackle the growing dog obesity crisis by educating owners about the range of different ways to get fit with their dogs..
In addition to the education campaign, Get Fit With Fido also includes a challenge that rewards the dog and dog owner who jointly lose the most weight, and the dog owner and dog who individually lose the most weight, as a result of exercising together. Prizes include a one night stay at the dog friendly, 4* boutique townhouse hotel Flemings Mayfair; a luxury dog bed from Charley Chau and Champagne Afternoon Tea for Two at the Milestone Hotel.
All dog owners who enter Get Fit With Fido, will receive a 20% discount on Crufts and Discover Dogs tickets; as well as advice, tips and tools for owners.
Veterinary practices are being asked to support the campaign by requesting free flyers and posters from the Kennel Club and then displaying them at reception, or in the waiting room.Caroline Kisko, Kennel Club Secretary, said: "Reports indicate that between 30 and 60% of all dogs are overweight so it is more important than ever we keep our dogs happy and healthy. One of the most serious findings in obesity studies that have proven to be related to being overweight in both humans and dogs is a reduced lifespan. An overweight dog is more likely to die younger than a dog of normal weight.
"The findings are shocking and we are trying to educate as many dog owners as possible and call on vets to spread the message of keeping your dog fit and healthy."

The webinar, titled 'Creating a positive relationship with cats and their owners in practice', will take place at 8pm on Wednesday 20 November. It will cover understanding of the cat’s natural behavioural patterns and their influence on feline behavioural responses, which are essential in order for veterinary professionals to effectively handle feline patients.

It's National Veterinary Nurse Week from 26th October to 1st November and vet nurses across the country will be raising awareness of the important job they do in caring for the nation's pets. Bonny Millar CVT(USA), RVN, REVN, Vice President of the BVNA and VN week organiser has called for vets and practice managers to support the initiative.
She said: "This is an ideal opportunity for practices to use their nurses to full effect. A lot of our efforts go on behind the scenes and so nurses are sometimes not fully appreciated by pet owners. We are encouraging practices to get their nurses out at front of house, running clinics and offering clients help and expert advice. Reducing barriers and educating the wider public about the role of the vet nurse can only be a good thing. Vets and practice managers know what a great contribution a good vet nurse can make to the practice and we would love to see them make a big effort to be ‘loud and proud' during National VN Week."
Bonnie added: "Last year hundreds of veterinary nurses took part in VN Week and we raised over £5000 for charity. This year our nominated charity is the Animal Cancer Trust so I hope practices really support their nurses in helping raise money for this important cause."
The British Veterinary Nursing Association is co-ordinating the various activities going on around the country and has arranged two pet health check days in Roundhay Park in Leeds on 26th October and Kensington Gardens in London on 1st November, sponsored by Hill's Pet Nutrition. Nurses are also being encouraged to make a special effort with prizes on offer thanks to sponsors Animalcare (Satellite Navigation system), Merial (lap top) and Vetoquinol (Nintendo Wii) for the most innovative event, most public involvement and most money raised for charity.

Companion Care has opened its 80th surgery, within the Ilford Pets at Home store.
Companion Care Vets managing director, Jane Balmain said: "The opening of our 80th surgery proves the success of our joint venture partner business model. This year the College is seeking nominations for six awards:
The Queen’s Medal: the highest honour that can be bestowed upon a veterinary surgeon for a highly distinguished career with sustained and outstanding achievements throughout.
The Veterinary Nursing Golden Jubilee Award: this award is aimed at veterinary nurses who have had a sustained and distinguished career, who can demonstrate a leadership role within the profession and who can act as an ambassador for the value of veterinary nurses and their work.
RCVS International Award: this award is for vets, vet nurses or laypeople who work internationally, from either within or outside the UK, in making an outstanding contribution to, for example, raising veterinary standards, veterinary education and improving animal health and welfare.
RCVS Impact Award: this award is for vets or vet nurses who have recently, or are currently, undertaking a project, initiative or similar that has a significant impact on the profession at large, animal health or welfare, or public health. Such impact could have been made through any field of veterinary endeavour, including clinical practice, research, education or veterinary politics.
RCVS Inspiration Award: this award is for vets or vet nurses at any stage of their career who have demonstrated the ability to inspire and enthuse others consistently throughout. It is open to those who have inspired and motivated individuals anywhere within the profession and recognises those who have gone ‘above and beyond’ what may normally be expected from a professional colleague.
Honorary Associateship: this honour is conferred to a small number of laypeople each year, in recognition of their special contribution to the veterinary sphere. It recognises the full range of individuals who contribute to the veterinary sphere including scientists, lecturers, journalists, charity-workers, farriers, farmers and those involved in the commercial field.
For this year’s honours and awards nomination period, the College has produced a video using footage from Royal College Day 2018, featuring interviews with those who were recognised with RCVS honours and awards on the day.

Dr Niall Connell, RCVS Junior Vice-President, is taking the lead in promoting the awards this year. He said: "Throughout my time in the veterinary profession, and particularly since joining RCVS Council, I have met so many veterinary nurses and veterinary surgeons who are truly inspiring individuals.
"The RCVS honours and awards scheme is a perfect opportunity to celebrate some of the individuals that have done or are doing something really special – whether that’s by inspiring their colleagues and peers or doing things that benefit animal health and welfare or society at large.
"Across all six awards there really is something for everyone – vets and veterinary nurses at all stages of their careers as well as laypeople are all up for recognition and so I’d strongly encourage everyone to think about someone they know who deserves recognition and get in touch.”
